I have been moaning long and hard about paying tax to both the UK and France on our Pensions.
Our UK Pensions are paid into our Current Accounts in the UK, (me) and France for Chrissie. They are all taxed at source then we have to declare them again to France and get taxed on them a second time. Mine was sorted a while back and I received a nice cheque from the DWP but Chrissies has dragged on and on.
To be taxed in France only, we have to supply a Document from the Tax Department in Millau to say we are tax resident in France, translations of documents from English to French and French to English and the relevant UK tax documents which we downloaded on-line. Also details of our UK banks, which was a problem as Chrissies account had been frozen. DWP agreed to pay anything owed into my account. And it would take about 6 months due to the backlog of work.
In the meantime we got Chrissies bank account unfrozen it took almost 2 years and needed a Notaire, and English to French and French to English translations. This was all getting very expensive.
After 8 months she had heard nothing so she wrote to the DWP and phoned them umpteen times, only to be put in a queue then cut off after a time without speaking to anyone.
About a month ago she tried phoning them again and after holding on for about 40 minutes actually got to speak to somebody. They agreed that they had the forms, and the subsequent letter but they had done nothing about it as they were busy, but they would look into it.
So it was surprise and a relief that she has received two letters, both dated the day she phoned them confirming that she will no longer pay UK tax and that the reimbursement will be in her next pension payments for both her Government and Private Pensions. Okay, she will have to declare the reimbursement on her tax declaration next year, but that's correct.
What is a bummer is that Chrissie took her AVC's as a lump sum and has to pay French tax on the whole sum whereas in the UK 25% of it is Tax Free.
We are dreading the Tax Bill in August. There is no PAYE in France. It is up to the individual to put it aside each month then it has to be paid in one go.
But the positive is that Chrissies mind is at rest. It has worried her no end, both the bank and Pension issues. And no more massive phone bills.
